DSA Notice + Action Mechanism: Submission Guidelines

As a hosting provider under the DSA, we have established a Notice + Action Mechanism for reporting content hosted by Namecheap where the content is believed to be illegal under European Union (EU) and/or a Member State law.   

DSA Requirements for Submission.

To help you, below are the elements required by DSA Article 16 for notices:

(a) A sufficiently substantiated explanation of the reasons why the individual or entity alleges the information in question to be illegal content;

(b) A clear indication of the exact electronic location of that information, such as the exact URL or URLs, and, where necessary, additional information enabling the identification of the illegal content adapted to the type of content and to the specific type of hosting service;

(c) The name and email address of the individual or entity submitting the notice, except in the case of information considered to involve one of the offences referred to in Articles 3 to 7 of Directive 2011/93/EU;

(d) A statement confirming the bona fide belief of the individual or entity submitting the notice that the information and allegations contained therein are accurate and complete.

It is important that, when providing a sufficiently substantiated explanation or otherwise meeting the above required elements, that you include all the relevant facts and an accurate reference to the law that you believe applies to ensure that we can identify the illegality of the relevant activity or information. Namecheap will thoroughly review your submission. However, under the DSA, it must not require that we conduct a detailed legal examination (Article 16.3) or do independent fact-finding (Article 8).

Please note that some situations may require a court finding. You may, at any time, choose to have a competent court, applying appropriate law, make a determination that the content in question violates EU and/or a Member State law.  Court findings may be attached and included in your DSA Report submission.
